New Legislation on Disclosure of Broker Compensation
Under the Consolidated Appropriations Act, all licensed insurance agents will be required to disclose compensation to clients of all group health plans and individual health insurance policies beginning December 27, 2021. The disclosure may also apply to compensation earned on other lines of coverage including dental, vision, chiropractic, and life. Additionally, indirect compensation, such as production bonuses, and non-monetary compensation exceeding $250, may require disclosure.
Disclosing compensation is new in the Small Group market, but standard practice in many other industries such as real estate and financial planning.
It’s important to remind your clients that whether they purchase insurance through you or directly through a carrier, the commission is included in the total premium.
